Terms and Conditions

§1. General provisions

The online store operating at
www.creativityshop.eu is operated by
CREATIVITY SHOP SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ,
with its registered office at: Al. Tadeusza Rejtana 53A/41,
35-326 Rzeszów, Poland,
registered in the Register of Entrepreneurs of the National Court Register of Poland
under KRS number 0001200582,
VAT (NIP): 8133941272, REGON: 543019192,
hereinafter referred to as the “Seller”.

These Terms and Conditions define the rules for using the online store,
placing orders, concluding sales contracts, payment and delivery conditions,
as well as the rights and obligations of the Seller and Customers.

The Store conducts retail sales of goods remotely via the Internet.

These Terms and Conditions are made available to the Customer free of charge
prior to the conclusion of a sales contract.

§2. Definitions

• Store – the online store available at www.creativityshop.eu
• Seller – Creativity Shop Sp. z o.o.
• Customer – a natural person placing an order in the Store
• Consumer – a Customer who is a consumer within the meaning of EU and Polish law
• Goods – products offered for sale in the Store
• Sales contract – a distance contract concluded between the Customer and the Seller

§3. Conditions of using the Store

1. To use the Store, the following are required:
   • a device with Internet access;
   • a valid e-mail address;
   • an up-to-date web browser.
2. The Customer is obliged to provide truthful and up-to-date information.
3. It is prohibited to provide or transmit unlawful content via the Store.

§4. Placing orders and conclusion of the contract

1. Orders may be placed 24 hours a day, 7 days a week.
2. In order to place an order, the Customer:
   • selects the Goods;
   • adds them to the shopping cart;
   • completes the order form;
   • selects the method of payment and delivery;
   • confirms the order.
3. The sales contract is concluded upon the Seller’s confirmation
   of acceptance of the order by e-mail.

§5. Prices and payment

1. All prices displayed in the Store are final prices and include
   all mandatory taxes (including VAT), unless stated otherwise.
2. Prices are indicated in the currency selected in the Store.
3. Available payment methods are indicated during the checkout process.
4. The Seller reserves the right to change prices; however,
   such changes do not affect orders placed prior to the change.

§6. Delivery

1. Delivery of Goods is carried out within the European Union
   and to other countries indicated in the Store.
2. Delivery costs and delivery time are indicated when placing an order.
3. The order processing time is calculated from the moment the payment is credited.

§7. Right of withdrawal (returns)

1. The Consumer has the right to withdraw from the sales contract
   without giving any reason within 14 calendar days.
2. The withdrawal period is calculated from the day the Goods are received.
3. To exercise the right of withdrawal, the Customer must submit
   a clear statement (e.g. by e-mail).
4. The refund will be made no later than 14 days from the date
   the returned Goods are received by the Seller.

§8. Complaints and liability

1. The Seller is liable for non-conformity of the Goods with the contract
   in accordance with applicable law.
2. Complaints should be submitted by e-mail to:

3. Complaints are considered within 14 calendar days.

§9. Personal data

1. The Seller is the controller of personal data.
2. Personal data are processed in accordance with applicable law
   and the Privacy Policy available on the Store’s website.

§10. Final provisions

1. The law of the Republic of Poland shall apply to relations between the Seller and the Customer.
2. Matters not regulated herein shall be governed by the provisions
   of the Polish Civil Code and consumer protection laws.
3. These Terms and Conditions enter into force upon their publication
   on the Store’s website.
